There is a duty of hospital and doctor to
obtain prior consent in emergency situation.
The patient death undergoing cannot be charged for medical negligence. If proper treatment is given and death care due to some complicated disease it cannot be held that hospital is negligent in treatment. In such cases patient cannot
file a case for malpractice and get compensation. A doctor can be charged if he
doesn’t follow standard reasonable Medicare while treating patient. If a doctor
made mistake in judgment of disease and patient suffer from severe damage then
patient can file a case.
Patient need to prove in the court that if
the case is handled by any other same profession he could not suffer from those
loses. If the patient gets success then hospital need to provide compensation

done in hurry manner then doctor can be charged for death of patient. The deserving
compensation is given to patient who has been injured by an act of medical negligence,
according to supreme court order.
