A bill called LASPO is about to come on early of April to provide fair legal aid. This bill stands for Legal AID Sentencing and Punishment of Offenders. The main aim of this rule is to provide fair justice. Most of the people injured in medical accidents are unable to apply for legal aids so this rule will give drastic impact on victims of clinical negligence. This will give victim some compensation.
What is happening in current scenario?
According to current rule, a patient can file a case against doctor for medical negligence. The legal aid ensures those who cannot afford lawyer or unable to file a case then support will be provided to them for negligence claim. If you get success in case then your solicitor negotiates all your losses occurred. So you will be paid accordingly. Your fees is also retuned in that case.
Claims related with neurological injuries to children will also get some compensation if they suffer from severe disability. The legal aid is also provided for pregnant women, child birth and many other situations. Rules such as no win, no fee will also be available from 1st April. Doctor will be claimed bypolice if he denies paying the bulk of your legal cost.
