Medico legal cases arises when the patient die shortly after admitted in hospital and the reason of death does not indicated properly. If some adverse happens to patient in the administration of healthcare providers or If the patient death occurs in the operation then it also comes under medical legal case . A legal taking care person ordered in all above situation. Medico legal expert finds the main reason and look the case from the beginning. They prepare documents by checking medical records.
According to section 39 in Criminal Procedure Code Of India, in all the above cases it is the legal responsibility of doctors to report to police immediately. This law is important to collect all evidence by police. The law states that patient should get basic and emergency treatment according to condition once patient enter in the hospital.
A hospital cannot deny any emergency case. They have to provide emergency treatment and if the condition Is worse which they cannot handle then they should transfer patient to nearest facility available. If a patient suicide is suspected then doctor is not supposed to report this matter in police station.
